1. Consumer data privacy policy

When you register to participate in the Great Canadian PitchFest™ the form requires your personally identifiable contact information such as your name, telephone number, e-mail address, postal code. By filling in this form, you are consenting to our collecting the personally identifying information so as to properly fulfill our very limited and specific purpose of ensuring that you are registered to participate in this year's Great Canadian PitchFest.

Twilight Pictures acknowledges your trust and is committed to protecting the information you provide us. To prevent unauthorized access, maintain accuracy, and ensure proper use of your personal information, we have employed physical, electronic, and managerial processes to safeguard and secure the information we collect online. We do not sell, rent, or share any of this information for any other purpose, other than noted below. We may also receive your non-personally identifiable information which is information that does not by itself identify your specifically. The non-personally identifiable data we collect when you visit our site may include the Uniform Resource Locator ("URL") of the Web site that you came from before visiting our site, which pages you visit on our site, which URL you next go to, which browser you used to come to our site, your Internet Protocol ("IP") address, and any search terms entered on our site. We do not link the personally identifiable information and non-personally identifiable information we collect on our site.

A Cookie is a piece of information that a Website will send to your computer when you are at that site. This information allows the site to remember necessary information that makes your use of that site more convenient. From time to time, we may be required to provide personally identifiable information in response to a court order, subpoena, or government investigation. We also reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful. We may release certain personally identifiable information when we believe that such release is reasonably necessary to enforce or apply our Service Provider Agreement or to protect the rights, property, and safety of others and ourselves.

2. Security capabilities policy

The Registration Fee is payable via a secured and recognized credit card payment site. We have no access to this information and are not responsible for any such information that you provide to that site.

3. Disclaimers of liability

Twilight Pictures is not responsible or liable to you as a Registrant, for:

  1. any harassing, defamatory, illegal or improper conduct or remarks by Decision-makers or for any infringement of intellectual property rights by Decision-makers;
  2. any infringement of your intellectual property rights by Decision-makers, agents, employees, representatives of Twilight Pictures, or any other participants of the Great Canadian PitchFest; or
  3. any interaction or dealings between you as a Participant and the Decision-maker, or any other Participant of the Great Canadian PitchFest at the Great Canadian PitchFest or at any other time.

4. Governing law

THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE SUBSTANTIVE LAWS OF ALBERTA (CANADA), WITHOUT REGARD TO CONFLICTS OF LAW PRINCIPLES. YOU AGREE TO INITIATE AND MAINTAIN ANY LEGAL ACTION IN SUCH DESIGNATED LOCALE AND IRREVOCABLY CONSENT TO EXCLUSIVE PERSONAL JURISDICTION AND VENUE THEREIN. YOU ARE RESPONSIBLE FOR COMPLYING WITH YOUR OWN LOCAL LAWS, WHICH MAY VARY WITH RESPECT TO CERTAIN ACTIVITIES OR PEOPLE (E.G., MINORS). You agree that Courts in Alberta can hear cases involving copyright or trade-mark issues. Since we make no warranties and have limited our liabilities, you should have little reason to have a grievance with us. Should you nevertheless bring legal action against us, you irrevocably agree it will be brought and maintained within one (1) year after the claim arises or be barred. As disincentive for unwarranted litigation, you agree that if you sue us and do not win on the merits, you will pay our defense costs, including reasonable legal fees for in-house and outside counsel. If we are required to enforce this Agreement or our rights, you agree it is reasonable to send you legal notices and papers by electronic mail at your stated address (we would also attempt to send you a backup copy by regular mail).

Disclaimer

The Decision makers participating in the Great Canadian PitchFest 2004, as indicated on our website, have indicated their willingness to be present. In the event that such decision makers are delayed, cancel their participation with or without notice, or are unable to attend for any reason, Twilight Pictures cannot be held accountable for such actions. Twilight Pictures will make every attempt to contact said decision maker, and endeavours to substitute such a Decision Maker with a suitable and comparable replacement. Wherever possible, such replacement will be posted on the website, but reserves the right to make substitutions without notice.
